I got an email from the same officer asking me to provide the contact number of the client that I worked in 2004.
duh..I dont have one..and that company (actually a Unit of GE) was bought over by a different company.

I hope thats your bravado speaking. Otherwise what you have stated is mostly inaccurate. Much as I would like to see Pakistan walloped for supporting the jehadi pigs, what war could potentially escalate into is far scarier than 200 people killed in Mumbai. It could mean the deaths of hundreds (or many times that) people - both Indian and Pakistani. That casualty number is not acceptable given that we've been absorbing thousands of losses in the last 50 years...scratch that - even in the last 20 years. IMHO Kargil was a bigger event than Mumbai than this since they had the b*lls to waltz onto Indian territory.
Strategically, India has no advantage pushing on to Islamabad (which is why we didn't in the wars earlier). Logistics will not support an invasion - primarily because the local population will not support it. And then it means killing thousands of non army personnel to hold on to territory and sustaining the same kind of losses. ('71 push to Dhaka was a contrast because the local population was supportive of India's/ Muktibahini push)

Also, the US will be more concerned about the Afghan border and will step up international pressure on India to let Pakistan be - worse - it could take an offensive posture against India as in '71 (like everyone else US cares about its interests first)

Repeal article 370 so that Kashmiri Pandits are assisted in returning to Kashmir along with other Indians (whatever religion so wants to). Rebuild Kashmir economically. Help liberal Pakis rebuild their country - and with a better economy, maybe good sense will prevail in that failed state.
Strength is not always an action of force. Strength is sometimes force of action - and India needs to be forceful in its actions - not relenting, not giving up until South Asia is a peaceful place again.
As someone who comes from an army family and who has been trained as a reserve, I want to assure you guys who think that an Indo-Pak war will linger; that it will not. It will take Indian army 15-20 days to reach Islamabad if the full force is deployed and the army is in charge of the war and not our politicians.
Pak has nukes, but their delivery mechanism is not sound and before Pak launches any nukes, US will disarm them and even if a few are launched India had a very good anti missile shield which will intercept and destroy all warheads before it enters Indian air.
Now to actual strategies that India should follow-
1. The civilian government in Pak is not at fault, previously they were responsible for terrorist attacks on India but now they are suffering at the hands of a monster of their own making. Terrorism and ISI.
2. India should use air and missile power to strike out and wipe out a 500km radius around each terrorist camps while offering an olive branch to the Pak govt. What this does is it will kill with certainty all terrorists and will also wipe out surrounding villages.
3. These are casualties of war and are a necessary evil, it will strike fear in the hearts of villagers and when ever a terrorist camp is set up; the surrounding villagers will chase them out in fear of India's wrath.
4. India should send RAW analysts to assassinate all rouge ISI officers, if needed Mossad of Israel can help India.
5. Finally the only way to deal with the problem of Pakistan longtime is to either socially cleanse Pakistan for the civilian government and bring in more modernism or carve out pakistan into several independent states. This is a long term goal which has to be thought about.
If anyone is interested I can post the actual army strengths of India and Pak, its an interesting statistic and I am sure the Pak government knows about it in more detail than me. And it beats me that in spite of knowing the facts they are doing all this war posing. Just a tit bit from it, Indian army (only) is 1.3mil + 450K (reserves) strong. The combined Pak armed forces are 450K active + 500K reserves. India outnumbers Pak in almost every aspect 1:5 on an average. We have fought 4 wars and India has won all 4 times, why should the 5th time be any different? Lets finish this and move on, we have to become an economic superpower and we cannot be bothered by such trivial things like terrorism and pakistan. I don't have the time to go one by one, but one of the arguments about "Zogby poll taken by anti-immigration" groups is at minimum comic. How about other polls posted along the years which show the obvious and logic, which is the American people (not employers of course) support lower immigration numbers ? Anyone surprised by that ?

Infact pro immigrants and Corporations are arguing that shortage of skills and they are not displacing US workers. If that is true why cannot they accept the conditions that they will not displace US workers. If you accept that you do not mind replacing some american workers also then all of your points are valid. Then you can lobby for unlimited H1b and Unlimited greencards. You will never get American people support for that. But we all are lobbying based on the shortage of skills. So we should be ready to reduce H1b when demand goes down or accept the conditions for non displacement of US workers. Right now demand is more so US will absorb even 200K H1bs. But you need to look what happened between 2000 to 2003. So many layoffs. Part of reason was economy but other part was due to H1b and outsourcing

Doesn’t this mean that someone in India is being replaced by American worker???? Maybe we should stop all trade and we should have all needs of one country fill within its borders. I will accept that 25 year old H1b from India can work 15 to 18 hours a day but same kind of productivity cannot get with 40 year old person with family of 2 kids whether Indian or American. Is it right to replace those person with 25 year old person. If that is the case then you will be replaced by youger H1b person in future.
In free market and capitalist economy, the measure of productivity doesn’t come from some lawmaker who is out of sink with reality or from the ideology of orgs like IEEE-USA or from posters like you. The measure of productivity comes from the employers and the companies. If employees on H-1Bs were unproductive then why are employers asking for more H-1Bs. I am sure my employer is not in love with me to give me check every two weeks. And if that is how it works best for the competitiveness and for the economy, society and the nation, then so be it. That is the reason why this society is more advanced. You may be afraid of such a situations/competitions but I am not scared of a scenario where someone who can perform a better job, either a citizen or someone on H-1B, takes my job. And I assure you that I won't whine about it. But that is ok, your way of thinking is all based on the premises that every one out is going to get you and some how you have to eliminate this competition at the soonest.

You can not blame everything on Jewish media. There is no point in you and me jumping up and down. The people that needs to realize should realize and focus on a workable solution.
Mumbai terrorism was discussed at length but you did not see the same level of discussion for LTTE's war with SLA. LTTE shares religion, language and ethnicity with lots of Indians but you DID NOT see the board discussing about that war a lot. What does that mean? Whether that stupid guy knows or not is not important. The most important thing is the American people. I guarantee that most Americans do not know how H1Bs contribute to the American society. If they are misinformed, the government and Congress can only further mistreat people like you and me. The real danger of those lies about H1Bs is that it will stir up a sentiment of anti legal immigrants

By the way, pro-immigration does not necessarily mean pro-legal immigration. Sometimes, the so called pro-immigration policies can only jeopardize those who are here legally, mainly those employment-based immigrant, most of whom take the F1-H1-GC route ... just like you and me. So be careful when we support any bills. We need to understand what exactly our legal immigrants get from the bill before we support it. :)

Your analysis is so spot on except for item #8 and item # 9. I have a question though.. The example you have given suits my scenario so well. I am planning to buy a house (310k ) very soon. The loan offers I have from my lender has interest rates pretty much the same for both 10% down payment and 20% down payment, 5.0 with 20% and 5.25 with 10% down payment. I can down pay 10% right away and the other 10% is also available in a risk free(can withdraw without penalty) cd which yield me a return of 3.5% . So which is better for me 10% or 20% down pay. thanks in advance.

It would require lobbyists to detail their own campaign contributions, as well as payments to presidential libraries, inaugural committees and charities controlled by lawmakers. The proposal would also put new disclosure requirements on special spending measures for pet projects, known as "earmarks."
"What we did today was momentous," declared House Speaker Nancy Pelosi (D-Calif.). "It's historic."
The bill is the most far-reaching attempt at ethics reform since Watergate, although it is not as aggressive as some legislators wanted in restricting the use of earmarks and in requiring the disclosure of donation bundling. The legislation, which had been stalled until negotiators worked out a deal in recent days to get it passed before the August recess, is a priority for Democrats, who won control of Congress in part because they had decried what they called "a culture of corruption" under Republicans.
Although it passed the House 411 to 8, the bill could face hurdles in the Senate, which is under a new ethics cloud after the FBI raid Monday on Sen. Ted Stevens's house. Last night, a group of Republican senators prevented Democrats from bringing up the bill, forcing the scheduling of a vote tomorrow to break the filibuster. Still, senators from both parties predicted easy passage by week's end.
Senate Majority Leader Harry M. Reid (D-Nev.) all but dared Republicans to try to block the proposal when it comes to a vote as early as tomorrow. "With that resounding vote in the House, 411-8, I think people ought to be concerned about voting against it," he said yesterday.
But in a closed-door lunch with fellow Republican senators yesterday, Stevens (R-Alaska) himself threatened to block the measure, objecting that the legislation's new restrictions on lawmakers' use of corporate jets would unfairly penalize members of Congress who live in distant states, such as himself.
The legislation would end secret "holds" in the Senate, which allow a single senator to block action without disclosing that he or she has done so. Members of Congress would no longer be allowed to attend lavish parties thrown in their honor at political conventions. Gifts, meals and travel funded by lobbyists would be banned, and travel on corporate jets would be restricted. Lobbyists would have to disclose their activities more often and on the Internet. And lawmakers convicted of bribery, perjury and other crimes would be denied their congressional pensions.
"These are big-time fundamental reforms," said Fred Wertheimer, president of the open-government group Democracy 21.
Rep. Michael N. Castle (R-Del.), who failed to get ethics legislation enacted last year, noted that the final bill's disclosure rules are considerably less tough on the "bundling" of small campaign contributions into large donations by lobbyists. The original ethics bill would have required the disclosure of bundled contributions over $5,000 every three months. Under the final bill, lawmakers would have to report every six months any bundled contributions from lobbyists totaling more than $15,000. In one year, a single lobbyist could funnel nearly $30,000 to a candidate or campaign committee without any of those actions having to be disclosed.
House negotiators also refused to lengthen the current one-year "cooling-off" period, during which former House members are prohibited from becoming lobbyists.
Some conservatives latched on to the weakening of earmark disclosure rules that had passed the Senate in January. An explicit prohibition on trading earmarks for votes was dropped by House and Senate Democratic negotiators. A prohibition on any earmark that would financially benefit lawmakers, their immediate families, their staff or their staff's immediate families was altered to say that the ban would apply to any earmark that advances a lawmaker's "pecuniary interest." Critics say that would mean the benefit would have to be direct for the measure to be prohibited, and that the ban would not apply to a project that would benefit a larger community, including the lawmaker.
House members are covered by earmark rules, passed earlier this year, that are tougher than the legislation, which would apply only to senators.
"Earmarks have been the currency of corruption and, unfortunately, this lobbying reform bill does not adequately address that problem," declared Rep. Jeff Flake (R-Ariz.), a longtime critic of earmarks.
Reform groups and Democrats accused opponents of using the earmark issue as a pretext to block the other rule changes. Sen. Tom Coburn (R-Okla.), who has blocked the legislation in the past, confirmed that he remains uncomfortable with the broader bill's mandates on lobbying disclosures and gift bans.
"You could've done nothing, or some staff member could have made an innocent mistake, and now you're defending yourself in a court of law," he said. "It's nuts."
Sen. Jim DeMint (R-S.C.), another critic, had single-handedly blocked the calling of a formal House-Senate conference to negotiate the final deal, forcing Democrats to hammer out the compromise on their own. The House passed it under fast-track procedures that prohibit amendments but require a two-thirds majority for approval -- a threshold that was easily met.
Now, Reid must get the bill through the Senate without any amendment, using a parliamentary tactic that has been roundly criticized by Republicans in the past as strong-arming. But in this case, Senate Minority Leader Mitch McConnell (R-Ky.) has given his tacit assent, laying the blame squarely on his own conservative hard-liners.
"In a sense, we made it difficult on ourselves," McConnell said.
It may be even more difficult for Republicans to block the measure while their senior senator, Stevens, is under a cloud of suspicion. FBI agents raided the powerful lawmaker's house Monday, looking for evidence in a long-running investigation of an Alaska energy firm, Veco, and its alleged efforts to bribe Alaska lawmakers.
And yesterday, the House ethics committee indicated that it may consider an inquiry into whether Rep. Heather A. Wilson (R-N.M.) violated rules by calling a federal prosecutor about a pending investigation. The committee's staff interviewed the prosecutor, former U.S. attorney David C. Iglesias, yesterday.
At least eight lawmakers -- six Republicans and two Democrats -- are under federal investigation. Earlier this year, the homes and business interests of Reps. Rick Renzi (R-Ariz.) and John T. Doolittle (R-Calif.) were searched, and Rep. William J. Jefferson (D-La.) was indicted on corruption charges.

How wonderful that congress is finally introducing constructive bills to prevent 'consultants' mainly (but not only) from India from clogging up the H-1B visa system for honest skilled workers. The H-1B program is clearly intended for people WHO HAVE A SOLID FULL-TIME JOB OFFER AT THE TIME OF FILING THE APPLICATION. The whole body-shopping/visa abuse phenomenon is just disgusting. I wouldn't cry if any and all kinds of 'consultancy' activity were banned from the H-1B program. Someone stated that then they 'might as well lower the cap to 10.000/year'. Obviously not true. This bill clears out the infested issues of people illegally taking up visas on false premises. Good work!
Part of the title of this thread reads 'even H-1 renewal will be impossible'. That is just priceless. No, H-1B renewal will be impossible IF YOU ARE NOT HERE BASED ON HONEST CIRCUMSTANCES. Anyone with trouble renewing H-1Bs after this bill should get a real job or leave if they are not up to that task.
I am not sure after reading your post above if you know the meaning of "consulting". To me it looks like you are focused on the narrow group that are labelled as "on-site" consultants. These are people you are hired by one company and perform their activities at a client site. Even among these people, not all have taken up jobs under false pretext.
First of all - consulting means performing work of temporary nature. It can be temporary due to any number of reasons - regular employee is on medical leave or on maternity leave, job is temp. in nature (an analogy would be that you hire a plumber to fix something in your house and you pay him either on a per-job basis or a per-hour basis) or you do not have expertise in-house to get the job done (the plumber analogy fits here too). Let me give you an example of each one of these.

Or - you would just keep all of them on the payroll and the 3 developers and 1 dba will just be coming to the office and doing nothing. Part of the title of this thread reads 'even H-1 renewal will be impossible'. That is just priceless. No, H-1B renewal will be impossible IF YOU ARE NOT HERE BASED ON HONEST CIRCUMSTANCES. Anyone with trouble renewing H-1Bs after this bill should get a real job or leave if they are not up to that task.
I am not sure after reading your post above if you know the meaning of "consulting". To me it looks like you are focused on the narrow group that are labelled as "on-site" consultants. These are people you are hired by one company and perform their activities at a client site. Even among these people, not all have taken up jobs under false pretext.
First of all - consulting means performing work of temporary nature. It can be temporary due to any number of reasons - regular employee is on medical leave or on maternity leave, job is temp. in nature (an analogy would be that you hire a plumber to fix something in your house and you pay him either on a per-job basis or a per-hour basis) or you do not have expertise in-house to get the job done (the plumber analogy fits here too). Let me give you an example of each one of these.
Regular Employee is on extended leave

if people have to debate this issue, surely we can do it without needless slander and accusations?
i agree with GC applicant, words like that do not sound right and have no place here please.
btw when the vertical spillover started, there was alot of angst, these last two years all retrogressed categories except EB3 ROW have suffered. so that is not true either. except that there was frankly nothing we could do about it. there were long debates similar to the current ones- then they were between Eb2I and EB3 ROW and no conclusion was reached of course, and nothing changed by screaming at each other. finally USCIS as stated by them, has taken counsel about that "change" they made and concluded that they made an error in interpretation. what they have actually done now is rolled back a change they previosuly made.
i also want to say to all the EB2 I crowd here- all this chest thumping is pointless. EB2 I will go back, a lot, this is just a temporary flood gate to use the remaining Gc numbers for the year. meanwhile, the plight of EB3I is truly bad. lets please keep working on the recapture/exemption/ country quota bill trio that would incraese available Gc numbers- for ALL our sakes.

"Love" stamps
A guy walks into a post office one day to see a middle-aged, balding man standing at the counter methodically placing "Love" stamps on bright pink envelopes with hearts all over them. The job description can be put in the way that points to your plus points. If you go the Harvard Biz. school you will have those. I dont think they want you to leave. There will be other avenues out there.
I am all for cleaning the system and reforming H1B - but I oppose an ill conceived half measure such as the one Senator Durbin/Grassley is proposing.
My main concern is two fold:
1. Let us assume I am a very bright individual and I am currently in Harvard. If I graduate from Harvard Business School, and I want to join McKenzie, can I do that? Can I ever be a Management consultant in US if I want to (read I as any random Joe who is not US citizen/GC holder)
2. Can I switch jobs within a couple of weeks if I need to (I refers to someone who works for a good company but perceives opportunities else where) - this is important as my competition (US citizen/GC holder) has no restriction in place for them. This is also important during recession when I might be a valuable asset to another company but the company cannot afford to wait.
My point is: definitely prevent abuse of the system, but not by putting more shackles on the hapless employee. Give the employee freedom to move anywhere for a certain period of time (could be 3 yrs renewable 2 times as per current H1b) and have strict penalties if this employee overstays visa etc.
Additionally, if employers abuse the system, send them to jail right away (and have whistle blower immigrant status protection). Make employers more accountable than they are today.
Just my 2 cents.....
