It should not be a problem. Our GC's were approved when we were overseas and we came in using AP's.
Try to bring print outs of approval from USCIS website. If you have that, they will admit you as a PR. I tried explaining but they didn't listen and used the AP. If you have a printout they willl stamp your passport as a PR and let you in.

Can anyone tell me if a PERM is first audited, and then reaudited, which one will be used for the priority date? the first one or the second one? or it does not matter (based on the date when the PERM was first filed)?

Can we file I-485, after August 1 2007 and
before August 17 2007 (as I'm preparing my medicals).Is there a chance USCIS stop taking the application after July 31 2007 by giving some crap reason?Also I understand that filing fee is same for I-485 until August 17 2007.Is that true even for I-765 and I-131.Please clarify.

Diversity Lottery ends in FY08. As a baby step, to offset this why dont we ask these numbers - 50,000 to be added to EB visa quota?

Hello
I'm A medical student who has come to do a 1 month internship(Clinical Elective) at a University on a F-1 visa valid till mid may 2009 .My internship here ends at the end of march. I have also 2 internships(cliinical electives) scheduled for the month of May and June as well at ANother University . The main problem is that the other univ require me to be on a B-1 and not on a F-1 . My present school has called them and requested them but they rejected the plea. They want me on B-1 . Now my question is that "Can I change my status from a F-1 to a B-1 while in US" - I have a valid visa which is not yet expired .
It would be appreciated if u can tell me about the forms that I shall need to fill in for the same ? Do I need to hire an attorney for it ?

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

Earlier today, I mentioned this provision which would bar DHS from using funds to delay or rescind the no-match rule. The amendment passed by a voice vote, but in consulting with a knowledgeable source, it seems likely that the amendment will not have much affect. That's because it bars DHS from using funds from its 2010 budget for this purpose. As long as DHS rescinds the rule before September 30th (which now seems likely given yesterday's DHS announcement), no 2010 funds would be needed to achieve this result. So I would not count on the no-match letter being resurrected any...

The USCIS announced on June 1, 2006 that the regular H-1 cap for Fiscal Year 2007 (FY2007) was reached on May 26, 2006. Those cases properly filed with the USCIS before the 26th are safe, with respect to the cap, as there are enough cap numbers for these cases. Cases that reached the USCIS on May 26th are in an uncertain situation and will be subject to a random selection process, as there are enough numbers for some, but not all of the May 26th cases. Any regular cap-subject cases received after May 26th will be rejected entirely.This information does NOT impact advanced degree cases, for which cap numbers are still available.
